Fukuro Legal has taken part in a report published by Law&Trends entitled “A trial before the Alicante Provincial Court reopens the debate on professional impersonation involving fake lawyers acting as cryptocurrency advisers.”
The report addresses the trial currently taking place before the Alicante Provincial Court against a man accused of posing as a specialist in legal advice related to cryptocurrency fraud, allegedly defrauding dozens of individuals. The case has reopened the debate on professional impersonation within the legal sector, particularly in complex and relatively new areas such as crypto-assets.
Jorge Agüero Lafora, partner at Fukuro Legal, contributes to the report by analysing the implications that such practices have both for citizens and for the legal profession itself. As Jorge explains, when someone presents themselves as a lawyer without actually being one, it not only constitutes deception but also takes advantage of the vulnerable position in which many people find themselves when seeking legal assistance.
Professional impersonation can have serious consequences for victims, who may lose money, time and important legal opportunities. At the same time, it also harms those professionals who have completed the required legal education and qualification process and who practise in accordance with the standards and guarantees demanded by the profession.
This phenomenon tends to arise more easily in areas where there is greater uncertainty or lack of knowledge, as is often the case with cryptocurrencies. Many people who have been victims of online fraud urgently seek ways to recover their money, which can create an environment in which supposed experts promise quick or specialised solutions.
In this context, one of the most effective ways to prevent such situations is the verification of professionals. Checking whether a lawyer is registered with a bar association is a simple process that can be carried out through the public directories provided by bar associations.
