Summary

Many visitors believe drugs are legal in Spain. They are not, although Spanish law draws a sharp line between personal use and trafficking. This guide explains what is an administrative fine and what is a crime, the reality of cannabis clubs, and the risks at airports.

Are drugs legal in Spain? It is one of the most common questions from visitors, and the Spain drugs legal situation is often misunderstood. The short answer is no: drugs are not legal in Spain. What is true is that Spanish law does not treat personal drug use as a crime. Using or carrying drugs in public is an administrative offence punished with a fine, while selling, sharing for profit or transporting drugs can be a criminal offence with prison sentences of several years. This guide explains where the line is drawn, how cannabis clubs really work and what happens at airport checks.

Key points

Is personal drug use legal in Spain?

Personal use is not a criminal offence in Spain, but that does not make it legal. Under article 36.16 of the Public Safety Act (Organic Law 4/2015), consuming or illegally possessing drugs in streets, public places, establishments or public transport is a serious offence, even if the drugs are not intended for sale.

Serious offences carry fines of 601 to 30,000 euros (article 39). In the lowest band, the fine ranges from 601 to 10,400 euros. The police can also seize the drugs. Beaches, bars, nightclubs, festival grounds and hotel common areas are all public places for these purposes. [VERIFY: whether consumption in a hotel room or private terrace visible from the street can fall under article 36.16]

Growing plants in places visible to the public, such as a balcony, is also a serious administrative offence where it is not a crime (article 36.18).

Possession vs. trafficking: where the line is

The crime is defined in article 368 of the Spanish Criminal Code. It punishes those who grow, produce, sell or otherwise promote, favour or facilitate the illegal consumption of drugs, or possess them for those purposes. The penalties are:

The courts may impose a lower penalty where the offence is of minor importance and the personal circumstances of the offender justify it, but not where aggravating circumstances apply.

The key question in most cases is whether the drugs were for personal use or for supply. Courts look at the quantity and purity, how the drugs were packaged (for example, in individual doses), cash, scales, messages on the phone and whether the person is a user. The Supreme Court has used reference quantities for personal consumption. [VERIFY: Supreme Court reference quantities for personal consumption and the "shared consumption" doctrine] Note that giving drugs to friends, even for free, can also be treated as trafficking.

The penalties for trafficking and how they are defended are covered in our article on drug trafficking penalties and defence.

Cannabis clubs: legal or not?

Cannabis social clubs exist in many Spanish cities, particularly in Barcelona and the Balearic Islands, and are often advertised to tourists. They are private associations that claim to grow and distribute cannabis only among adult members for their own consumption.

No specific national law regulates them. The Supreme Court has held that organised cultivation and distribution of cannabis within associations can amount to drug trafficking, and several club managers have been convicted. Airport checks

Airports are where many tourists first meet Spanish drug law. Police and customs officers carry out checks on arrival and departure, including luggage scanners and sniffer dogs.

If you are stopped or arrested, you have the right to a lawyer, to an interpreter and to remain silent. Our guide to your rights when arrested in Spain explains them in detail.

Frequently asked questions

Is weed legal in Spain?

No. Cannabis is a controlled substance. Private consumption by adults is not a crime, but consumption or possession in public is fined, and selling or supplying it is a crime.

Will a drug fine give me a criminal record?

An administrative fine under the Public Safety Act is not a criminal conviction, so it does not appear on the criminal record. A conviction for trafficking does. [VERIFY: registration of administrative sanctions and possible consequences for residence or visa applications]

Can I bring cannabis from a country where it is legal?

No. The fact that cannabis is legal in your home country does not change Spanish law. Bringing it into Spain can be treated as smuggling or trafficking.

What happens if I am caught with drugs on holiday?

If the quantity is small and clearly for personal use, the most likely consequence is a fine. If the police suspect supply, you may be arrested and brought before a judge, sometimes within a day or two.

Conclusion

Drugs are not legal in Spain. Personal use is punished with fines rather than prison, but the line between possession and trafficking is narrow, and quantity, packaging and context can turn a holiday incident into a criminal case.
