Jorge Agüero Lafora participated in an important trial at the Audiencia Nacional, defending the only accused of a terrorist murder crime. The defense argued that the client was not involved in the crime, and that the Spanish court did not have jurisdiction as the crime was committed abroad and had no connection to the Spanish state. Additionally, it was argued that the interpretation of the terrorist crime used in the case was against the principle of legality.

The defense's central argument was not only the lack of the client's participation in the facts, but also the lack of jurisdiction of the Spanish courts due to the lack of link of the crime committed abroad with the Spanish State, due to the loss of Spanish nationality of the victims before the commission of the facts and also by the interpretative application of the terrorist type against the principle of legality, as it was imputed an interpretation of a crime that at the time of the facts did not exist.
